                                 AGREED UNITED STATES TRUSTEE'S EX PARTE MOTION

                                                      FOR CONTINUANCE OF HEARING

 

            NOW COMES the United States Trustee, by and through her undersigned counsel, and hereby moves this Court for the entry of an Order continuing the hearing on the United States Trustee's Motion  now set for June 19, 2006,  with respect to the above-styled Chapter 7 case.  In support thereof, the U.S. Trustee states as follows:

            This is a core proceeding concerning the administration of the estate pursuant to 28 U.S.C. Sec. 157(b)(2)(A) which this Court may hear and determine pursuant to Administrative Order 84-12-Civ.-Misc., dated July 11, 1984, of the United States District Court for the Southern District of Florida.

            On November 29, 2004, this case was commenced by the filing of an involuntary petition for relief.   Debtor accepted relief under chapter11 of the Code on or about May 20, 2005.  No Plan of Reorganization has been filed.  The United States Trustee brought a Motion to Dismiss on May 3, 2006.  The hearing on the United States Trustee's Motion was set for June 19, 2006 .

            At this time, the Debtor and Debtor’s counsel and petitioning creditors’ SEC counsel have prepared a draft Plan of Reorganization and submitted the same to the SEC in Atlanta for review.  Counsel for the SEC, as well as counsel for the Debtor,  have requested, and the United States Trustee has agreed to, request a continuance of the hearing from this Court for the following reasons:

            The Securities and Exchange Commission needs more time to review the Plan.

            WHEREFORE the United States Trustee prays this Court continue the Hearing on the United States Trustee's Motion to Dismiss for approximately 30 days, or until this Court may conveniently set a date.
